This Legal Notice supplements and is governed by the VIBEQUEST Terms of Service and the other policies incorporated there (together, the “Legal Terms”). Where this notice references a right, remedy, limitation, or dispute-resolution procedure, the full and controlling terms are stated in the Terms of Service. In the event of a conflict, the Terms of Service control, except where mandatory law provides otherwise.

2. Legal Notices and Service of Process

Email does not constitute legal notice to VIBEQUEST, and the customer-support address is not an address for service of process. Formal legal notices and service of process must be delivered in writing to VIBEQUEST LLC. Notices delivered to any other address, or by any other means, are not effective.

3. Limitation of Liability; Claims Only Against the Company

VIBEQUEST LLC is a limited liability company. To the fullest extent permitted by law, any claim arising out of the Site or the Products may be brought only against VIBEQUEST LLC, and not against any member, manager, officer, employee, contractor, or agent of the company in their individual capacity.

THE VIBEQUEST PARTIES' LIABILITY IS LIMITED AS SET FORTH IN THE TERMS OF SERVICE, WHICH INCLUDE A DISCLAIMER OF WARRANTIES, A CAP ON DAMAGES, AN ASSUMPTION-OF-RISK PROVISION, A ONE-YEAR LIMITATION PERIOD, BINDING ARBITRATION, AND A CLASS-ACTION AND JURY-TRIAL WAIVER. THOSE PROVISIONS ARE INCORPORATED HERE BY REFERENCE AND AFFECT YOUR LEGAL RIGHTS.

4. Trademarks and Trade Dress

VIBEQUEST™ and the VQ logo™ and the names of VIBEQUEST Products are trademarks of VIBEQUEST LLC, whether or not marked with a ™ symbol on any given page. The distinctive appearance, shape, design, and packaging of the Products constitute protected trade dress. Any use of a VIBEQUEST trademark, trade dress, product name, or product image — including in advertising, resale listings, comparative marketing, metatags, or social media — without our prior written permission is prohibited and will be enforced to the fullest extent of the law.

5. Patents

VIBEQUEST Products and designs are protected by one or more pending United States patent applications. Patent pending. Copying, imitating, or commercially reverse-engineering VIBEQUEST Products or designs may infringe our rights and will be pursued. Any patents that issue may be identified on a patents page on the Site, and such virtual marking constitutes notice under 35 U.S.C. § 287(a).

All content on the Site — including text, images, product photography, graphics, video, design files, page layout, and logos — is owned by or licensed to VIBEQUEST and protected by U.S. and international copyright law. No content may be reproduced, distributed, scraped, harvested, indexed for resale, used to train or develop any automated or machine-learning system, or otherwise exploited without prior written permission. Automated access to the Site other than by standard, good-faith search-engine indexing is prohibited.

7. Digital Millennium Copyright Act (DMCA)

We respond to notices of alleged copyright infringement that comply with the DMCA. If you believe content on the Site infringes your copyright, send a written notice containing the information required by 17 U.S.C. § 512(c)(3) to our designated agent:

8. Authorized Channels; Anti-Counterfeiting

Genuine VIBEQUEST Products are sold only through vibequestluxe.com and directly by VIBEQUEST at authorized events. We do not authorize sales through third-party marketplaces or resellers unless expressly agreed in writing. Products obtained from any unauthorized channel are not covered by the First Flight Guarantee or the Limited Warranty, may be counterfeit, used, or altered, and are purchased at your own risk. We investigate and pursue counterfeiting, gray-market resale, and unauthorized use of our brand, and we may deactivate serialized benefits for units traced to unauthorized channels.

9. Third-Party Trademarks; No Endorsement; Reviews

Names, logos, and marks of third parties — including airlines, events, carriers, and service providers such as Shopify — are the property of their respective owners. Reference to any third party or its marks is for identification only and does not imply affiliation, sponsorship, or endorsement in either direction. Customer reviews and testimonials reflect the individual experience of the person who provided them, are not a guarantee of results, and may not reflect the typical experience of all customers.

10. Product Safety

VIBEQUEST Products are personal comfort accessories — not safety devices, medical devices, therapeutic devices, child-restraint systems, personal protective equipment, or certified aircraft or vehicle equipment. When using a Product aboard an aircraft or in any vehicle, keep all seatbelts and restraints fastened, visible, and unobstructed; follow all crew or operator instructions; and remove or stow the Product when instructed. Full product-use, assumption-of-risk, and dispute-resolution provisions are in the Terms of Service and govern all use of the Site and all purchases.

11. No Medical Claims

Products are not intended to diagnose, treat, cure, or prevent any condition, and no statement on the Site is a medical claim. Consult a physician before use if you have circulatory, spinal, or other conditions that may be affected by seated travel.

Disputes are resolved as provided in the Terms of Service, including binding arbitration in Maricopa County, Arizona, and a class-action and jury-trial waiver, subject to the opt-out and carve-outs stated there.
